Terms and Conditions

These Terms and Conditions govern access to the Naples Beach Concierge ("N.B.C.," "we," "us," or "our") website and requests for Beach Experiences, Experience Enhancements, and Concierge Services.

By submitting a service request, approving a confirmed reservation, or using a confirmed N.B.C. service, you agree to these Terms and Conditions and the applicable N.B.C. policies.

Eligibility

You must be at least 18 years old and legally capable of entering an agreement to request or purchase N.B.C. services.

The person submitting a request is responsible for providing accurate information and communicating these terms and applicable policies to every member of the group.

Service Requests and Confirmation

Submitting a reservation or Concierge Service request does not guarantee service, availability, pricing, equipment, placement, or a particular beach location.

A service becomes confirmed only after N.B.C.:

  • Reviews the request and availability
  • Confirms the service details in writing
  • Provides the final or applicable pricing
  • Receives the customer’s approval
  • Receives any required payment

Only the details contained in N.B.C.'s written confirmation are included in the confirmed service.

N.B.C. may accept, decline, or request modifications to a submission based on availability, location, weather, safety, beach requirements, service capacity, or operational limitations.

Beach Experiences

N.B.C. currently offers the following Beach Experiences:

  • Classic Escape — up to two guests
  • Coastal Comfort — up to four guests
  • Signature Experience — up to six guests

Each standard Beach Experience includes four reserved hours and the equipment, delivery, setup, bottled water and ice, and teardown specifically listed in the confirmed experience description.

Photographs may show representative arrangements. Equipment quantities are determined by the selected and confirmed experience.

Additional equipment, time, paddleboards, celebration arrangements, and other enhancements are included only when separately requested, priced, and confirmed.

Operating Schedule

Beach Experience start times are available at 9:00 a.m., 10:00 a.m., 11:00 a.m., or 12:00 p.m., subject to availability.

Standard experiences last four hours. The Add an Hour enhancement requires advance approval, and every experience must end no later than 5:00 p.m.

Concierge Services are available from 9:00 a.m. through 5:00 p.m., subject to availability. An "As Soon as Available" request does not guarantee immediate service or a specific delivery time.

Pricing and Payment

Website prices represent the currently displayed service prices but remain subject to correction or change before a reservation is confirmed.

The price stated in N.B.C.'s written confirmation controls the confirmed reservation. Any additional charge must be disclosed and approved before it is added.

Payment instructions and deadlines will be provided during confirmation. Failure to make a required payment by the stated deadline may result in release of the requested date, time, equipment, or service capacity.

Experience Enhancements

Experience Enhancements are subject to availability and may carry separate charges.

An enhancement is not reserved merely because it was selected or mentioned in a request. It becomes part of the reservation only when N.B.C. confirms it in writing.

The Add an Hour enhancement cannot extend an experience beyond 5:00 p.m.

Concierge Services

Standard local pickup and delivery includes a $25 service fee plus the actual cost of the requested items.

The standard service fee covers one approved pickup-and-delivery request to Lowdermilk Beach, Naples Beach, or Vanderbilt Beach.

Multiple stops, unusual distances, large orders, parking costs, special handling, equipment requests, or complex requests may require additional charges. N.B.C. will disclose the expected total and obtain customer approval before purchasing requested items.

Customers are responsible for providing accurate item, quantity, brand, size, pickup, order, and substitution information.

Vendor availability, pricing, preparation time, product quality, and inventory are controlled by the original business and cannot be guaranteed by N.B.C.

N.B.C. may decline requests involving age-restricted, controlled, unlawful, unsafe, unavailable, or operationally unsuitable products.

Pharmacy-related requests remain subject to provider identification, authorization, privacy, and pickup requirements. N.B.C. does not provide medical advice, select prescription substitutions, or accept private medical information through its website forms.

Customer Responsibilities

Customers agree to:

  • Provide complete and accurate reservation information
  • Remain reachable using the phone number or email provided
  • Follow N.B.C. instructions and lawful directions from public authorities
  • Arrive at the confirmed location and time
  • Supervise children, dependent adults, and other group members
  • Use equipment only for its intended purpose
  • Protect personal belongings
  • Vacate the setup and collect personal property at the confirmed end time
  • Avoid conduct that is unlawful, dangerous, disruptive, or damaging

Customers are responsible for transportation, parking availability, parking charges, and access to the confirmed beach location.

Arrival, Location, and Public Beaches

N.B.C. will provide arrival guidance and the setup location before the confirmed start time.

Exact placement cannot be guaranteed because public-beach space is affected by crowds, tides, weather, access, wildlife protections, safety conditions, and instructions from local authorities.

N.B.C. does not reserve or provide an exclusive section of a public beach.

Late arrival does not extend the confirmed ending time or reduce the reservation price. Early departure does not create a refund or prorated price reduction.

Cancellations, Changes, and Weather

Cancellations, reservation changes, weather decisions, refunds, credits, delays, and service interruptions are governed by the N.B.C. Cancellation and Weather Policy.

A requested change is not effective until N.B.C. confirms it in writing.

Government closures, emergency orders, lightning warnings, and directions from beach or public-safety officials take priority over every reservation.

Equipment Care and Damage

N.B.C. retains ownership of all provided equipment.

Customers may not remove equipment from the confirmed setup area, transfer it to another party, use it for an unintended purpose, or continue using it after N.B.C. or a public authority directs them to stop.

Customers may be responsible for reasonable repair or replacement costs resulting from intentional damage, misuse, unauthorized relocation or removal, or loss during the reservation.

Normal wear resulting from proper use is not considered customer damage.

Paddleboard Activities

Paddleboard use is subject to availability, water and weather conditions, participant ability, applicable safety requirements, and any separate acknowledgment or waiver required by N.B.C.

N.B.C. may decline, delay, suspend, or discontinue paddleboard use when conditions are unsuitable.

N.B.C. does not provide lifeguard services, swimming instruction, childcare, or continuous participant supervision.

Assumption of Outdoor Risks

Customers understand that beach and water activities involve inherent risks, including sun exposure, heat, dehydration, lightning, wind, waves, currents, tides, marine life, insects, wildlife, uneven sand, and changing weather or water conditions.

Each participant is responsible for evaluating their health, abilities, swimming ability, and comfort before participating.

Parents and responsible adults must supervise children and dependent adults at all times.

Third-Party Products and Services

Restaurants, stores, pharmacies, payment processors, social-media platforms, and other outside providers operate independently from N.B.C.

N.B.C. is not responsible for third-party policies, inventory, ingredients, allergens, preparation, product suitability, website content, processing systems, delays, or independent acts or omissions.

Customers are responsible for confirming dietary, allergy, medical, prescription, compatibility, and product-use concerns directly with the original provider.

Personal Belongings

Customers are responsible for their phones, keys, wallets, medications, valuables, and other personal property.

To the fullest extent permitted by law, N.B.C. is not responsible for personal belongings that are lost, stolen, left unattended, or damaged by sand, water, weather, other beach visitors, or ordinary beach conditions.

Service Refusal or Termination

N.B.C. may decline, suspend, or terminate service when:

  • Conditions are unsafe
  • A request violates applicable law or beach requirements
  • A customer provides materially inaccurate information
  • Required payment or approval is not received
  • A customer or guest misuses equipment
  • Conduct threatens people, property, operations, or public safety
  • The request falls outside N.B.C.’s service area or operating capacity

Any refund or credit following termination will be determined under the applicable policy and the circumstances causing termination.

Website Use

Customers may use the website only for lawful purposes related to reviewing or requesting N.B.C. services.

Users may not interfere with website operation, submit fraudulent requests, impersonate another person, attempt unauthorized access, introduce malicious software, scrape website content, or misuse N.B.C. branding or materials.

Intellectual Property

The N.B.C. name, website text, branding, graphics, photographs, service descriptions, and original materials belong to N.B.C. or their respective authorized owners.

Website access does not grant permission to reproduce, modify, distribute, sell, or commercially use these materials without written authorization.

Privacy

Information collected through the website is handled according to the N.B.C. Privacy Policy.

Disclaimer and Limitation

N.B.C. will provide confirmed services with reasonable care, subject to weather, public-beach conditions, government restrictions, vendor performance, and circumstances outside its reasonable control.

To the fullest extent permitted by law, N.B.C. is not liable for indirect, incidental, special, or consequential losses arising from website use, third-party products, delays, cancellations, or circumstances outside N.B.C.'s reasonable control.

Nothing in these Terms excludes or limits any right, duty, remedy, or liability that cannot lawfully be excluded or limited.

Force Majeure

N.B.C. is not responsible for failure or delay caused by severe weather, lightning, natural disasters, emergencies, road or beach closures, government action, utility or technology failures, vendor interruptions, public-safety instructions, or other circumstances outside its reasonable control.

Refunds or credits arising from weather or beach conditions remain governed by the Cancellation and Weather Policy.

Governing Law

These Terms and Conditions are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally will be handled by a court with proper jurisdiction in Collier County, Florida, unless applicable law requires otherwise.

Changes to These Terms

N.B.C. may revise these Terms when its services, website, pricing structure, operations, or legal obligations change.

The version accepted in connection with a confirmed reservation will govern that reservation unless the customer and N.B.C. agree otherwise in writing.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the fullest extent permitted by law.

Entire Agreement

These Terms, the written reservation confirmation, and the applicable N.B.C. policies constitute the agreement governing the confirmed service.

If the written confirmation contains a specific term that conflicts with general website content, the written confirmation controls for that reservation unless prohibited by law.
