Inherent Outdoor Risks
Beach and water activities involve inherent risks, including sun exposure, heat, dehydration, wind, lightning, waves, currents, tides, uneven sand, marine life, insects, wildlife, and changing weather or water conditions.
Guests are responsible for evaluating their health, abilities, swimming ability, and comfort before participating.
Nature of N.B.C. Services
N.B.C. provides beach-hospitality services, equipment delivery, setup, and removal. N.B.C. does not provide lifeguard services, swimming instruction, medical supervision, security, childcare, or continuous monitoring of guests or equipment.
Adults are responsible for their own conduct and safety and for supervising every child, dependent adult, and other guest included in their reservation.
Equipment Use
N.B.C. equipment must be used only for its intended purpose and in accordance with provided instructions.
Guests must not improperly reposition umbrellas, misuse equipment, remove equipment from the setup location, or continue using equipment after N.B.C. or a public authority directs them to stop.
Customers may be responsible for reasonable repair or replacement costs resulting from intentional damage, misuse, unauthorized removal, or loss of N.B.C. equipment during the reservation.
Paddleboard Use
Paddleboard use is subject to weather, water conditions, participant ability, applicable safety requirements, and any separate acknowledgment or waiver required by N.B.C.
N.B.C. may decline, delay, or discontinue paddleboard use when conditions are unsuitable. Children and inexperienced participants require appropriate adult supervision.
Personal Belongings
Guests are responsible for protecting their phones, keys, wallets, medications, valuables, and other personal belongings from loss, theft, sand, water, weather, or damage.
Food, Products, and Third-Party Items
For restaurant, grocery, refreshment, pharmacy, or other Concierge Service requests, N.B.C. acts as a pickup-and-delivery service and does not manufacture or independently guarantee the requested items.
Customers are responsible for confirming ingredients, allergens, dietary suitability, prescription information, product compatibility, condition, and intended use with the original provider.
Delays and Interruptions
N.B.C. is not responsible for delays or interruptions caused by severe weather, emergency conditions, road or beach closures, government action, vendor delays, utility failures, or other circumstances outside its reasonable control.
Representative Photography
Website photographs may show representative arrangements. Exact appearance, placement, and equipment quantities will correspond to the confirmed experience and may vary because of beach, weather, and environmental conditions.
Independent Business
N.B.C. is an independent business and is not affiliated with, sponsored by, or endorsed by the City of Naples, Collier County, or any public beach or park authority.
Nothing in this policy limits any right, duty, or liability that cannot lawfully be limited.
